In 2018, the State of Washington passed HB 2057 regarding real property foreclosure, abandoned property, and successors in interest to deceased borrowers. It requires due diligence and notice requirements for all nonjudicial foreclosures in the event of a deceased borrower. The trustee must provide notice of the foreclosure to all known heirs, and if unknown, perform due diligence to locate all heirs.
